Woman Faces Homicide Charge in Fatal Drug Overdose

A 26-year-old Brookfield woman is facing a reckless homicide charge after a man she was with fatally overdosed on oxycodone, according to a criminal complaint filed Wednesday in Waukesha County Circuit Court.

Jessica J. Hintz faces up to 40 years in prison if she is convicted of selling the oxycodone that killed 25-year-old Matthew D. Dziatkiewicz in November 2011. A warrant has been issued for her arrest on the homicide charge.

According to the complaint:

Officers from the Waukesha Police Department were dispatched to an apartment building at 1300 Blackhawk Trail at 12:44 a.m. Nov. 5 for the overdose. Dziatkiewicz was not responsive on the living room floor, and after CPR attempts were made by the Waukesha Fire Department, he was transported to Waukesha Memorial Hospital.

Hintz told an officer she poured water on Dziatkiewicz in an attempt to wake him up but was unsuccessful. He had been drinking alcohol and had taken prescription pills that were prescribed to him, she told authorities.

But when  investigators went to search the apartment for items that could have caused the overdose, Hintz told a detective she provided Dziatkiewicz with oxycodone.

Hintz showed officers a plastic baggie of the oxycodone pills, which she told police she received from a friend at a bar in Milwaukee instead of money the friend owed her. Hintz told police she had consumed two of the pills and Dziatkiewicz had five of them.

An investigator was informed Nov. 11 that Dziatkiewicz had died at the hospital. An autopsy report from the Waukesha County Medical Examiner’s Office shows that he died from a combination of oxycodone and alcohol intoxication, the criminal complaint states.
