Waukesha Teen Found Guilty of Child Pornography Possession

Richard Chavez, 19, had 30 out of 34 felony charges dropped after he pleaded no contest to four felony charges.

A 19-year-old Waukesha man will be sentenced next month on four felony charges of possession of child pornography by a person under age 18.

The man, Richard Chavez, was charged in February 2011 with 34 felony counts of child pornography possession after investigators with the were contacted by the Wisconsin Department of Justice after it was confirmed Chavez was downloading files through a peer-to-peer network. The files downloaded were known as child pornography.

In a plea deal on Thursday, Chavez pleaded no contest to four felony charges and prosecutors dropped the remaining 30 counts against him. He will be sentenced at 2 p.m. Feb. 29.

According to the criminal complaint:

Police executed a search warrant on Oct. 27, 2010, and told Chavez that they believed either he or his father was using the computer to download the child pornography. Chavez told investigators that his father did not use the computer.

“I may have accidently downloaded some child pornography,” Chavez told investigators.

Chavez then told investigators he downloaded the files because he did not believe the titles of the videos and pictures that were online. Chavez said that there were no images of the videos he downloaded, so he had to download each file in order to view it.

Chavez said he downloaded about 50 to 60 videos and watched each file about three or four files. Chavez also told investigators he looked at the porn even though it made him sick to his stomach. He said he was not a predator and does not touch children.

“This makes me sick,” Chavez told investigators. “This isn’t me.”
