Update: Waukesha Police Arrest Man on Felony Warrants

Man charged with sexual assault of a child had evaded officers for months, according to police department.

A 28-year-old man who has evaded police for months was taken into custody by the on three felony warrants at Tuesday morning, according to a news release from Capt. Ron Oremus. The man had evaded police for months.

Police were notified at 7:08 a.m. that the man was in the residence.

The warrants for the man, David Helser, included one from the Department of Corrections, one for felony larceny and one for sexual assault of a child, the release states.

Police set up a perimeter around the residence in the 300 block of Prospect Avenue and asked neighbors to stay in their basements or leave the neighborhood as a safety precaution, Oremus said.

The occupants of the residence exited and confirmed to police that Helser was in the residence, possibly sleeping in a bedroom, Oremus said in the release. Initial contact attempts were unanswered but police shot a baton round through his window. Helser then left the building voluntarily without incident at 9:26 a.m., which is when he was taken into custody.

“The community remained safe through the process,” states the news release from Oremus.

The Charges

Helser was charged Tuesday with sexual assault of a child under 16 years old. Helser is accused of molesting a teenage relative in March 2011 while Helser was naked, according to a document filed in Waukesha County Circuit Court.

“(The relative) stated that (the relative) is afraid of the defendant because of his temper, which (the relative) has seen in the past,” the criminal complaint states.

Helser was charged in Waukesha County Circuit Court on Wednesday with the theft of $2,500 that was kept in a lock box in Lannon, according to a criminal complaint.

The victim reported in April that he believed Helser had taken the money because Helser had seen the victim remove cash from the box in February, the complaint states.

The Lannon Police Department wanted to interview Helser about the theft but the complaint states that Helser had a warrant for a probation violation, as well as bench warrants for missing court in several counties.

Helser’s fingerprints were found on the lock box and on an envelope containing photographs that were inside the lock box, according to the complaint.

Helser also is charged with misdemeanor retail theft after being accused of stealing a welding machine valued at $467.98 and a welding helmet valued at $49.98 from in Waukesha on May 19, 2010. A Menards employee found the box with the welding covered by a jacket and the helmet covered by a sports bag in Helser’s vehicle as Helser was attempting to leave the lumberyard, according to the criminal complaint.

Helser had not paid for the items, the complaint states, and told police he intended to go back into the store to pay for the items after leaving the lumberyard. Officers discovered, though, that Helser did not have enough money to pay for the items or a credit card, the complaint states.

Helser also has two open bail jumping cases in Waukesha County and open bail jumping, operating while revoked and operating while intoxicated-third offense cases in Walworth County, according to online court records.
