Waukesha Man Faces 4th OWI After Passing Out in Running Car

Suspect told police he was drunk, but wasn't driving, according to the criminal complaint.

A 34-year-old Waukesha man is facing his fourth drunken driving charge after police found him passed out inside a running car Saturday night.

Jeremy L. Neal was charged in on Monday with one count of fourth offense operating while intoxicated. If convicted, he faces up to one year in Waukesha County Jail and $2,000 in fines.

Waukesha police were flagged down by two women near Maple Avenue and West Main Street who said they saw Neal passed out in a running car pulled to the side of the road at 10:03 p.m. His car was blocking a driveway and had one tire up on the curb with loud music blaring out of it.

Neal was slow to respond to officers, but told them “I’m intoxicated, but I’m not driving.” He also had an open beer sitting next to him.

He was unable to complete a field sobriety test and told officers he was going to jail and prison and demanded blood alcohol test be performed. Neal had a blood alcohol level of 0.20 percent at the time of the incident.

Neal was previously convicted of OWI in 2001, 2003 and 2006. He’s currently free on $600 cash bail while awaiting trial.
