Waukesha Man Charged with Sexual Assault

Criminal complaint alleges suspect offered pills and money to victim and her boyfriend in exchange for not telling anyone about the incident.

A 46-year-old Waukesha man is facing charges after he was accussed of sexually assaulted a 22-year-old woman while she was passed out at his apartment, according to a criminal complaint.

Kerry J. Hildebrand was charged in Waukesha County Circuit Court Monday with one count of third-degree sexual assault. If convicted, he faces up to 10 years in prison and $25,000 in fines.

According to the criminal complaint, on June 13, the victim and her boyfriend went to Hildebrand’s apartment where they played cards and watched television. Her boyfriend passed out at about 10 p.m. and she then passed out around 1 a.m.

The complaint states she later awoke to Hildebrand assaulting her and then offered her pills to not tell her boyfriend. The woman declined, however, and Hildebrand  allegedly locked himself in his bedroom and pretended to be asleep.

The victim and her boyfriend came back the next day but Hildebrand refused to open his apartment door, the complaint states, and eventually called another man who confronted the boyfriend and told him he would give him anything to not tell anyone about the incident. The boyfriend refused and came back again to Hildebrand’s apartment where the complaint alleges Hildebrand offered pills and money to not tell on him.

Hildebrand denied the incident ever occurred to investigators, the compliant states, and said the woman had told him she would report a sexual assault unless he gave her pills.

Hildebrand is currently being held in Waukesha County Jail on $3,500 cash bond.
