Waukesha Man Charged With Punching Woman and Stealing Phone

Complaint alleges suspect followed his ex-girlfriend and punched her in the face while trying to take her phone.

A 45-year-old Waukesha man is facing charges after he allegedly punched his ex-girlfriend in order to take a cell phone from her, according to a criminal complaint.

David J. Kennedy was charged in Waukesha County Circuit Court Tuesday with one count of misdemeanor battery and one count of disorderly conduct. If convicted, he faces up to one year in prison and $11,000 in fines.

According to the criminal complaint, at 5:30 p.m. Sunday, Kennedy’s ex-girlfriend and new boyfriend went outside her apartment in the 300 block of North West Avenue when Kennedy came walking towards them. The woman, who alleges Kennedy has been harassing her, told him to go away, which he did.

Several minutes later, the complaint states the woman and her boyfriend were walking outside the apartment when Kennedy began to follow them in a pick up truck and then got out and began to walk alongside them on foot and then tried to grab a cell phone out of the woman’s hand.

The three got into a tussle and Kennedy punched the woman in the face and escaped the scene with her cell phone, according to the criminal complaint.

The complaint states Kennedy was arrested Monday and told officers he was being “set up” and refused to give further statement without a lawyer present.
