Waukesha Man Charged With 5th OWI

Suspect was caught speeding through Town of Brookfield with no license in his car.

A 40-year-old Waukesha man is facing his fifth drunk driving charge after he was caught speeding through Town of Brookfield.

Derek B. Asunto was charged in Waukesha County Circuit Court on Monday with one count of fifth-offense operating while intoxicated, one count of felony bail jumping and two counts of misdemeanor bail jumping. If convicted, he faces up to 13 ½ years in prison and $40,000 in fines.

At 4:54 p.m. Saturday, a Town of Brookfield police officer on patrol spotted Asunto accelerating quickly on northbound Barker Road near Davidson Road. The officer used his radar and saw Asunto was doing 58 miles per hour in a 40 miles per hour speed zone and continued to accelerate.

The officer reached 76 miles per hour before finally catching up and pulling him over in the parking lot of Heritage Christian School.

Asunto told the officer he was just trying to get home, but left his driver’s license at home and it’s a bad one. He was trying not to face the officer while talking and denied drinking.

He failed a field sobriety test and had a blood alcohol level of 0.157 perecent. He was placed under arrest then began to swear at officers and became belligerent while being taken into custody.

Asunto was previously convicted of OWI twice in 2000, and once in 2003 and 2006. He’s currently being held in Waukesha County Jail on $100,000 cash bond.
