Waukesha Man Charged With 5th OWI

Man is caught driving through Franklin Sunday with an open bottle of vodka at his feet, according to criminal complaint.

A 47-year-old Waukesha man is facing a felony drunken driving charge after he was caught driving in Franklin with an open bottle of vodka at his feet, according to a criminal complaint.

Terry A. Nisleit was charged in Milwaukee County Circuit Court on Tuesday with one count of fifth offense operating while intoxicated. If convicted, he could face up to six years in prison and $10,000 in fines.

Nisleit was driving in the 7700 block of West Ryan Road Sunday evening when a Franklin police officer spotted him illegally passing another car and pulled him over. While interviewing Nisleit, the officer discovered he had a suspended license due to drunken driving and he told the officer he had been drinking earlier in the day.

The officer also spotted an open bottle of vodka sitting on the floor by Nisleit’s feet. Nisleit failed a field sobriety test and had a blood alcohol level of 0.10 percent.

Nisleit was previously convicted of OWI twice in 1994, 1997 and 2008. He’s currently being held in Milwaukee County Jail on $500 bail.
