Waukesha Man Charged After Cops Find Pot Plants by Apartment Entrance

Suspect, 60, allegedly allowed another man to use planters in his sun room to grow marijuana in exchange for the benefit of what the plants would harvest.

A 60-year-old Waukesha man is facing charges after officers discovered marijuana plants in a sunroom by the entrance of his apartment when they came to arrest another man, according to a criminal complaint filed in Waukesha County Circuit Court.


Michael J. Lapp was charged in Waukesha County Circuit Court Monday with one count of manufacture and delivery of THC, the active ingredient in marijuana, and one count of possession of drug paraphernalia. If convicted, he faces up to 43 months in prison and $10,500 in fines.

According to the criminal complaint, officers went to Lapp’s apartment in the 1100 block of White Rock Avenue in July 2010 in order to take another man into custody for harassment. In order to get to the door to the apartment, officers had to walk through a sun patio area where one officer noticed marijuana plants in plain view.

Lapp came home at the same time officers had noticed the plants, the complaint states, and he gave them permission to look in his apartment where they discovered a pipe used for smoking marijuana and a plastic jar containing the substance.

The complaint states Lapp told investigators another man had approached him about planting the marijuana on the porch in exchange for the benefit of whatever harvest was collected from the plants.

Lapp will make his initial appearance in court June 8.
