Waukesha Man Caught in Lewd Act Outside an Elm Grove Condo

A cook at the Silver Spur was caught by a woman who was walking back to her Elm Grove condo; a criminal complaint says he had past arrests for similar incidents.

A Waukesha man was caught masturbating in the bushes outside of an Elm Grove woman's condo, a criminal complaint alleges.

Sergio Arias Torrijos, 35, was charged in on Tuesday with one count of lewd and lascivious behavior. If convicted, he faces up to nine months in jail and $10,000 in fines.

On May 9, a woman left her condo in the 13300 block of Watertown Plank Road and was walking to a nearby bank to get money when she saw a van pull out of Silver Spur Texas Smokehouse BBQ and drive slowly behind her. The van then pulled into the parking lot of Park 'N Shop, turned around and drove off.

The woman said she thought the driver must have been lost, but as she was walking back home she saw the same van coming northbound on Elm Grove Road, turn onto Watertown Plank and back into the Silver Spur parking lot. She lost sight of the van and continued walking home until she heard a man’s voice and saw Arias Torrijos masturbating in the bushes nearby.

She yelled at him to get a life and ran inside where she called police. Officers talked with the owner of the Silver Spur who said the van belongs to Arias Torrijos who works there as a cook.

Arias Torrijos first told police he had been picked up by family in the van, but refused to talk about past arrests he had for similar incidents. He then told them he made a "mistake" and was spotted in the bushes by the woman.

He will make his initial appearance in court July 23.
