Waukesha Man, 73, Caught Masturbating at Elm Grove Park

Man who was caught in a similar instance at Brookfield Square several years ago gets an "urge" in his car after walking past three women having a conversation, according to a criminal complaint.

A 73-year-old Waukesha man is facing charges after he was caught masturbating in front of three women who were talking in front of the Elm Grove village pool in March, according to a criminal complaint.

Richard V. Waters was charged in on Tuesday with one count of lewd and lascivious behavior. If convicted, he faces up to nine months in prison and $10,000 in fines.

On March 7, three women were walking around the perimeter of the pool and talking. When they reached the east side of the area, they continued to talk and Waters walked by them and keep going.

One woman said Waters was wearing a bright coat and he turned back to look at the three of them, which she took as an acknowledgement of the good weather.

However, as they continued to talk, Waters got into his car and pulled up and parked right in front of the women. One woman recognized him as the man they just passed and didn’t give it any further thought, but he stayed there for another 10 to 15 minutes while they wrapped up their conversations.

One woman left and began to walk towards her car when she noticed Waters had his penis out and was masturbating. She tried to signal her friends who were still standing on the sidewalk and chatting.

The woman got his license plate number and went directly to the police station to report the behavior. She said she didn’t initially feel threatened by his presence, the woman said the fact Waters moved his car closer showed it was deliberate and it needed to be reported.

Police found Waters in his car at the lot and he told them he had been checking out the soccer field and while walking back he passed the three women and felt a “sudden sexual urge” to gratify himself after seeing them.

Waters initially denied having past contacts with the law, but police discovered he had been ticketed for similar behavior several years ago at Brookfield Square Mall.
