Town of Waukesha Man Charged After Fight About Heroin

Suspect, 25, tried to kick out the window of a squad car while being taken into custody, according to complaint.

A 25-year-old Town of Waukesha man is facing charges after he allegedly tried to kick out a squad car window after he got into a fight with two people at a Mukwonago home because they were upset he had done heroin in their bathroom, according to a criminal complaint.

Michael B. Martell was charged in Waukesha County Circuit Court Wednesday with one count of obstructing an officer and one count of disorderly conduct. If convicted, he faces up to one year in prison and $11,000 in fines.

According to the criminal complaint, at 9:09 a.m. Tuesday, officers were called to a home on Highway E in town of Mukwonago because Martell had been “bothering” a woman who lives in the home and her dad threatened to run him over with his truck because he refused to leave.

Martell had argued with the woman after she was upset he had shot up heroin in the home because she’s a recovering addict. While they were arguing, Martell then allegedly hit her in the chest and tossed a bag of drug paraphernalia into a ditch and left, the complaint states.

Upon arriving at the residence, Martell had already left, but officers found him nearby at E and Highway EE, but he gave them a fake name. He denied using drugs or having left the bag of paraphernalia despite having erratic behavior while talking with officers, complaint states.

He was then arrested, but then tried to kick out a window in a officer’s squad car. Officers then placed straps around his feet, but he was able to slip his boots off and again kick the window of the car with his bare feet, the complaint states

While being processed at Waukesha County Jail, officers also discovered he had been involved in another incident where he gave a false name to officers and charged him with another count of obstructing an officer.

He’s currently being held on $750 cash bail.
