Report: Waukesha Man Killed When Burglarizing Home

WTMJ-4, Fox 6 says man was shot dead by Okauchee home owner.

Updated: Waukesha County District Attorney Brad Schimel told a reporter with the Milwaukee Journal Sentinel that Babe was not armed when he was shot. However, the prosecutor still needs to investigate whether or not the shooting was justified.

A Waukesha man was killed in a Okauchee home invasion when he told a home owner that he had a gun early Saturday morning. The home owner was armed and killed the man, according to a report from WTMJ4.

TMJ4 identified the Waukesha man as 39-year-old James Babe IV.

Fox6 is reporting that the district attorney’s office will review Babe’s death. Babe’s family members are disputing that Babe would threatened anyone with a gun.

Babe, a registered sex offender, is a man who is familiar with law enforcement.

Babe was charged in 2004 with disorderly conduct, with possession of marijuana in 2002, with battery in 1999, disorderly conduct in 1998, second degree sexual assault of a child in 1992, burglary in 1992 and taking and driving a vehicle without owner’s consent in 1991. Babe was convicted on the charges.
