Not Guilty by Mental Defect Plea Entered in Child Sexual Assault Case

Gary Abt of Waukesha is charged with first-degree sexual assault. He changed his plea Monday from not guilty.

A Waukesha man charged with first-degree sexual assault of a child changed his plea Monday to not guilty by reason of mental disease or defect, according to online court records that also indicate the case is suspended.

Gary P. Abt, 48, was charged in February for assaulting a 3-year-old girl he was babysitting. He initially told police there were about 20 such contacts, but then changed that number to five, according to a complaint.

Abt had originally pleaded not guilty back in February, but changed the plea Monday.

According to online court records, a psychological exam was ordered and the next court event is a May 24 hearing. An additional record from today’s hearing says that he is not competent to stand trial and that the case is suspended.

Abt remains jailed on $10,000 bail.
