Man Charged After Drunken Row at Restaurant
Suspect fights with staff at Montecito Restaurant after he refuses to pay for two vodka shots, according to criminal complaint.
A 50-year-old Waukesha man is facing charges after he got into a fight with an employee at an area restaurant after he came in drunk and became agitated with staff.
David Austin was charged in Waukesha County Circuit Court Wednesday with one count of disorderly conduct. If convicted, he faces up to 90 days in jail and $1,000 in fines.

At 9:37 p.m. March 20 Austin walked into the bar area of drunk and began asking for different types of beers. After the bartender told him they didn’t serve those types of beers, Austin became agitated and instead ordered two shots of vodka.
Austin refused to pay for the shots, but threw money at the bartender. He tried walking into the restaurant area of the building and told staff to shut up when they told him not to walk there.

Eventually an employee was able to grab Austin and escort him out while he asked “where are you going to hit me.” Once outside, Austin threw a backpack and plastic bag full of beer cans he had to the ground and attacked the employee.
When police arrived Austin had very slurred speech and he was unable to intelligibly answer questions from officers.
He will make his initial appearance in court June 25.
