Man Accused of Sexually Assaulting Young Girl

Wayne D. Herbes, 56, is accused of taking naked pictures of the victim and touching her inappropriately on several occasions, according to a criminal complaint.

A 56-year-old Hartland man, who previously lived in Waukesha, is facing charges after he allegedly sexually assaulted a young girl inside a Waukesha home on multiple occasions in 2011.

Wayne D. Herbes was charged in on Thursday with three count of first-degree sexual assault of a child less than 13 years old. If convicted, he faces up to 180 years in prison.

An 8-year-old girl was interviewed by Waukesha police officers in December 2011, where she told them Herbes had assaulted her on several occasions in the summer of 2011 inside his home in the 1300 block of East North Avenue in Waukesha.

The girl said the first incident took place while she was waiting to take a shower and Herbes touched her inappropriately. The girl told police she knew the action was wrong and backed away from him.

On another occasion, the girl was completely naked when Herbes took a picture of her. On the third occasion, the girl told police Herbes molested her.

Herbes is currently out of custody and a warrant has been issued for his arrest.
