Former Waukesha Man Charged With Burglary, Theft by Contractor [UPDATED]

A former Waukesha man already charged with burglarizing the Pewaukee Starbucks where he was employed was charged with burglarizing a Waukesha residence on Thursday.

Daniel A. Groth, 39, of Oshkosh was charged Monday in Waukesha County Circuit Court with burglary and two counts of felony bail jumping. If convicted, he faces up to 13-1/2 years initial confinement in prison and $45,000 in fines.

Waukesha police officers were called to the 100 block of East St. Paul Avenue at 11:46 p.m. Thursday after a man said he returned to his apartment to find his bedroom “in complete disarray,” the complaint states.

The man found his TV, DVD player, laptop and other belongings on his bed and believed the suspect was spooked from the home. The man told police was missing $200, according to the complaint.

The man told police he believed Groth had entered the residence as he has a narcotics addiction and has been criminally prosecuted for taking money to support his drug addiction, the complaint states.

Another man, who allowed Groth to stay at his home because Groth was homeless, called the man on East St. Paul Avenue to say he found a prescription bottle with the man’s name on it in Groth’s possession, the complaint states.

The other man told police he saw Groth take about 11 pills outside a downtown Waukesha bar. When they arrived at the man’s home on White Rock Avenue, Groth pulled out 20 CDs from his sweatshirt pocket before leaving the home. The man called police after Groth left the White Rock Avenue home, according to the complaint.

Groth was stumbling when a police officer made contact with him. He admitted to being at a home on White Rock Avenue but he wasn’t sure who he had talked with at the residence, the complaint states.

Police also located a work jacket owned by the man living on East St. Paul Avenue at the White Rock Avenue residence.

Groth was also charged Tuesday in Milwaukee County Circuit Court with theft by contractor stemming from an October 2011 incident. Groth took $11,993 for a siding job, but instead of completing the work, he spent the money on cocaine, according to the criminal complaint in Milwaukee County.

In addition to burglary charges involving the Pewaukee Starbucks, he is on bail after being accused of stealing checks in Waukesha.

Groth remains jailed in lieu of $20,000 bail.
