Complaint: Man Walks Away From Cops, Dumps Keys in Toilet

Suspect, 37, is found in a bathroom stall at Master Z's with his keys in the tank of a toilet and is then charged with his fifth drunken driving offense.

A 37-year-old Waukesha man is facing felony drunk driving charges after he refused to pull over his motorcycle for police, then drove to an area bar and went inside to hide his keys in a toilet tank.

David J. Mueller was charged in Waukesha County Circuit Court on Monday with one count of fifth offense operating while intoxicated, one count of failure to obey a traffic officer and one count of obstructing an officer. If convicted, he faces up to 7-½ years in prison and $30,000 in fines.

At 8:45 p.m. Sunday, a police officer on patrol near North Grandview Boulevard and Northview Road spotted Mueller driving a motorcycle and accelerating at a high rate of speed to pass between two cars, then cut off one of the cars in an unsafe manner. Mueller continued to speed up despite being in a 35 miles per hour speed zone.

The officer tried to pull Mueller over, but he continued to drive, eventually pulling into the parking lot of where he parked in front of the bar and walked in despite commands from the officer.

Police entered the bar and were directed toward the bathroom where they found Mueller inside a stall with his keys inside a toilet tank. When asked if he had been drinking, Mueller said “well yeah” and when asked how much he responded “quite a bit.”

He was taken to Waukesha Memorial Hospital to perform field sobriety tests, where he then began to threaten the officers. He eventually took and failed the tests and had a blood alcohol level of 0.193 percent.

Mueller was previously convicted of OWI in 1999, 2001, 2004 and 2008.

Mueller is no longer in jail after posting his $5,000 bail.
