Drug Sale Took Place in South High Classroom, Police Say

A 17-year-old student is charged with selling marijuana to another student in a room at the school.

A marijuana sale in an art room at Waukesha South High School has resulted in felony charges for a 17-year-old Waukesha man.

Ryan Smith was charged with a felony of possession with intent to deliver, which normally carries a maximum sentence of 3½ years. However, because the offense was within 1,000 feet of a school — in this case, in a school classroom — five years can be added to the maximum term.

According to a complaint, Smith and another student were spotted by a teacher on Feb. 14 going into a “kiln room” and closing the door behind them, though neither had a project and there was no reason for them to be there.

Police questioned one student, who said he paid Smith $20 for the marijuana that was then found in his backpack. Smith denied having any role in the transaction.

Two months later, Smith was a passenger in  a car that was pulled over. Marijuana was discovered inside, and after further denials Smith eventually claimed responsibility for the marijuana.
