Delafield Woman Busted for 4th OWI in Waukesha

Criminal complaint alleges suspect had consumed pain killers and gave an officer a credit card as proof of ID.

A Delafield woman is facing her fourth operating while intoxicated charge after she was pulled over in Waukesha after consuming Oxycontin pills.

Kim Gardner, 57, was charged with one count of fourth offense OWI within five years. If convicted, she faces up to six years in prison and $10,000 in fines.

According to the criminal complaint, at 10:46 p.m. Saturday, officers were alerted to a burgundy car that had nearly hit another vehicle and a pole. An officer spotted the car waiting at a red light in the northbound side of White Rock Avenue.

The officer followed the vehicle and watched it swerve from the left hand lane to the right hand lane of traffic and eventually pull into a Citgo gas station. Gardner then got out of the car and stumbled into the gas station, stumbled back to her car and then hit a curb while trying to leave the gas station, which prompted the officer to pull her over, the complaint states.

When asked to provide identification, Gardner gave the office a credit card. She also admitted to consuming the pain pills and had also take a generic Prozac pill earlier in the day, according to the complaint.

Garnder was previously convicted of OWI in 2003, 2004 and 2008.
