Defense Attorney in Homicide Asks to be Removed from Case

Edgar Montano faces three homicide counts in the July 2012 death of a Waukesha woman and also an unborn child. His attorney asked to be removed from the case Monday, six weeks before trial.

The attorney for a Waukesha man charged with homicide by intoxicated use of vehicle asked to be removed from the case during a hearing Monday in Waukesha County Circuit Court.

Edgar Montano is also charged with homicide by intoxicated use of vehicle of an unborn child and three other felonies in connection with the . The Waukesha woman was struck while pushing her car along Highway 164/59.  A passenger in Montano’s car suffered a miscarriage after the accident, leading to the second homicide charge.

A jury trial is scheduled to begin April 30 but on Monday, attorney Gerard Kuchler requested to be removed from the case, according to online court records. Judge Patrick Haughney said he would take the matter under advisement, and ordered the clerk’s office to see if Montano is eligible for a public defender.

Kuchler has been Montano’s attorney since early August, according to online court records. Montano remains in Waukesha County Jail on $250,000 bond.

Another hearing is scheduled for 8:15 a.m. March 25.
