City Hires Outside Attorney in Police Disciplinary Case

Waukesha police officer appealing a 15-day suspension with the Police and Fire Commission.

A Waukesha police officer is fighting a 15-day suspension for violating department rules and regulations, which is forcing the Common Council to hire an outside attorney to represent Police Chief Russell Jack in the case.

Officer Kurt Gehrke is contesting the discipline before the Police and Fire Commission. Since the city attorney’s office represents the commission, it can’t also represent the because of the conflict of interest. The Common Council Tuesday approved the hiring of an outside attorney for the case.

Jack told the Finance Committee Tuesday night that an officer has not contested disciplinary action against him or her in about a decade.

“It is very rare that … (suspensions) are contested to the Police and Fire Commission,” Jack said.
