Blaring Music Leads to Felony Drunken Driving Charge

Suspect is found passed out in his car at 4:30 a.m. with the music blaring after he spent the previous day drinking gin and tonics on a farm, according to a criminal complaint.

A Waukesha man is facing felony drunken driving charges after he passed out in his running car while leaving the stereo blaring in an apartment parking lot early in the morning, according to a criminal complaint.

David J. Durski, 37, was charged in on Monday with one count of fifth offense operating while intoxicated. If convicted, he faces up to six years in prison and $10,000 in fines.

At 4:29 a.m. Sunday, police were called to an apartment complex parking lot near Fielding Lane and Crest Lane after someone reported loud music coming from a car. When police arrived they found the car idling with the windows cracked and Durski passed out in the driver’s seat, leaning across the center console. The music was so loud officers could hear it from 50 feet away.

Before waking Durski up, the officers shut off the car and took the keys out. Durski was unresponsive to the officers but woke up slowly when they began to nudge him with a baton.

When he woke up, Durski went for the ignition, but officers told him to stop. He failed a field sobriety test and had a blood alcohol level of 0.17 percent.

He told police he had taken several prescription pills earlier and spent the previous day drinking gin and tonics on a farm.

When asked to go in for a blood test, Durski refused. When officers told him he will submit to the test, he told then to stun him with a Taser.

Durski was previously convicted of OWI in 1997, twice in 2000 and once in 2007. He’s currently free on $1,000 bail while awaiting trial.
