Striking Curb Leads to OWI, Drug Charges

Waukesha man is charged after he allegedly hits a curb in front of a cop while driving through the city.

A 27-year-old Waukesha man is facing charges alleging he hit a curb in front of a cop while driving drunk with drugs in his car.

David W. Sevallius was charged in Waukesha County Circuit Court Tuesday with one count of second offense possession of THC, the active ingredient in marijuana, one count of possession of drug paraphernalia and one count of second offense operating while intoxicated. If convicted, he faces up to four years in prison and $11,600 in fines.

According to the criminal complaint:

On Sept 18, a Waukesha police officer was on patrol when she spotted Sevallius take a right turn onto St. Paul Avenue and hit the curb on the median, then keep going. The officer sped up to catch the car and she found it coming out of the Kohl’s parking lot. She pulled Sevallius over on Grandview Boulevard near MacArthur Road.

Sevallius smelled of intoxicants and told the officer he lost control of the car and gave it too much gas and that’s how he hit the curb. When asked how much he had to drink, Sevallius said two beers.

Sevallius failed field sobriety tests and had a blood alcohol level of 0.11 percent. The officer searched Sevallius’ car and found a marijuana pipe and a baggie of marijuana.

He was previously convicted of OWI in 2007. He’s currently free on a $1,500 signature bond.
