Waterslide Collision at Country Springs Hotel Results in Personal Injury Lawsuit

Waukesha man claims he was injured on Cyclone ride on Valentine's Day in 2010, and seeks unspecified damages.

A Waukesha man has filed suit against Country Springs Hotel, saying it was negligent when it allowed a rider to travel down a waterslide after him, resulting in a collision.

Robert and Dale Flowers, a married couple residing in Avalon Square Senior Housing in downtown Waukesha, filed a personal injury lawsuit Wednesday in Waukesha County Circuit Court against Country Springs Hotel. The couple is seeking unspecified damages from the incident that occurred nearly three years ago, according to the complaint.

The lawsuit alleges that on Valentine’s Day in 2010, Robert Flowers was at the waterpark and went down the “Cyclone” waterslide. When he stood up in the pool below the slide’s trough, the complaint states, he was hit by another rider. The collision caused him to fall backward and sideways, striking his head and neck on the slide’s trough.

The lawsuit claims Country Springs Hotel did not have a video feed available to employees to tell them when a rider cleared the slide. Instead, they have one employee at the top of the waterslide telling riders when to go and another at the bottom of the slide.

Robert Flowers received “pain, suffering and disability, hospital expense, medical expense, loss of earnings and earning capacity,” according to the lawsuit. His wife, Dale, “sustained the loss of services, society and companionship of her husband,” according to the complaint.

The Cyclone ride at Country Springs Hotel is described by the website www.waterparks.com as “a thrilling single person body slide.”

Michele, how old or ignorant are you that you don't know enough to keep your mouth shut when entering a high volume of water at high speed?? I suppose you want to sue also. Btw, I'd shut my mouth when walking into swarms of insects, too-just sayin'.

Anyone that frail should stay off of water slides. Fining the plaintiff $1000 for stupidity and disbarring his lawyer would be a good way to solve this.

How long was he "standing" up? I hope this gets tossed with the plaintiff charged the legal bills.

I agree that the folks at this Kwik Trip are great at assisting disabled people like myself but IRead More disagree that all Kwik Trips are helpful. There is a law that all gas stations are to assist you if you have disabled plates or a hanging placard if you press the help or disabled key on the pump. If there is no key (and I think all must have them by a certain date) then you are to honk horn twice and if there are at least 2 employees on duty, they are to assist. The K/T on St. Paul is useless. I've waited there, watching at least 3 employees mill around the counter with 1 or 2 customers and ingnore me. The Grandview station same but I haven't tried them in a few months. The worst station for that is whatever the one on St. Paul and Prarie is. I pulled in to see a female worker standing on side of building smoking. When she went in she was greeted by a male worker and I was ignored by both. I'd like to do a survey on how helpful each gas station is to the disabled. Kudos to Fleetfoot Kwik Trip! Whatever they got they should share with their brethren. I would rather give my $ to K/T because they are WI based and they donate regularly to the Salvation Army
