Dunkin' Donuts Fighting Drive-Through Window Ban

Should Dunkin' Donuts get exception to Waukesha County's restriction on drive-through windows? The Town of Waukesha takes up the rezoning request next week.

Dunkin’ Donuts is fighting a ruling that prohibits drive-through restaurants at its planned location at S30-W24836 W. Sunset Drive.

The Town of Waukesha Board of Supervisors previously approved a Dunkin’ Donuts restaurant complete with a drive-through window, much to the dismay of local coffee shop owners at neighboring Le Caffe’ Bistro, who were denied a similar drive-through. However, the drive-through is prohibited via Waukesha County’s governance.

“The Town of Waukesha has unknowingly taken action to approve a site plan and building  that conflicts with the limitations recorded in the enrolled ordinances,” states a Plan Commission document. “The approval of the Dunkin Donuts was conditioned upon resolving the apparent conflicts with the county limitations and the pending action on this petition will rectify the previous oversight.”

A public hearing for Dunkin’ Donuts rezoning request will be held at 6:30 p.m. July 11 at Town Hall, W250S3567 Center Road. The owners of the proposed 5,040-square-foot retail center that would have four tenants – including a Dunkin’ Donuts – is requesting the town adopt a new zoning code that would:

  • Eliminate restrictions on restaurants with drive-through windows
  • Eliminate Waukesha County’s oversight on zoning for the parcel
