Weapon-Related Ordinance Change Delayed Monday Night

Waukesha aldermen want to review state law before changing city ordinances.

A proposal to amend the city’s code book to be aligned with the state’s new open carry law was delayed Monday night by the Ordinance & License Committee. The tabling of the ordinance change was requested to give the committee members a chance to review the law.

“The amendment to our ordinance conforms to the changes in state law which slightly modifies the exception to the restriction to discharging a firearm,” said Curt Meitz in a memo to the Ordinance & License Committee.

The change to the ordinance would prohibit a firearm from being shot in the city “unless the actor’s conduct is justified or had it been subject to a criminal penalty, would have been subject to a defense described in sec. 939.45 Wis. Stats.”

Already allowed to shoot a firearm under the city ordinances was police officers and anyone with the permission of the police chief.

“There are some basic, minor changes,” Alderman Steve Johnson told the committee.

Meanwhile, a debate has broken out on the state level about the number of hours of training in firearms a person should receive before obtaining a concealed carry permit. The requirement for four hours of firearms training to obtain the license was removed Monday by the Legislature’s Joint Committee for Review of Administrative Rules, according to the Milwaukee Journal Sentinel.
