Waukesha Woman Charged, Spit in Officer's Face During Arrest

Suspect allegedly called police sobbing, but wouldn't tell them why she called and instead lunged at an officer.

A 23-year-old Waukesha woman is facing charges after she allegedly tried kicking a police officer while drunk and wearing only a backwards hooded sweatshirt.

Alyssa M. Malecki was charged in Waukesha County Circuit Court Monday with one count of attempted battery of a peace officer, one count of throwing bodily fluids at public safety workers and one count of disorderly conduct. If convicted, she faces up to six years and nine months in prison, and $16,000 in fines.

According to the criminal complaint, at about 2:11 a.m. Saturday, officers received a call from a residence in the 100 block of Kilps Court, which consisted of a woman crying into the phone and saying profane things about the police.

Upon arriving at the residence, the complaint states Malecki would only open the door slightly and told the officers to shut their flashlights off. She then let them in, when officers noticed she was only wearing a backwards hooded sweatshirt with the sleeves cut off.

The complaint states when officers asked Malecki why she had called police, she wouldn’t respond. However, after officers began to look through her apartment, she then became agitated and lunged at one of the officers.

Officers were able to handcuff Malecki, who then tried to get out of the restraints and told officers “I still have legs” and “I can still headbutt you.” She then attempted to kick and grab an officer several times in the groin, but continuously missed.

She then spit in the face of one of the officers before they were able to place her in a restraint chair and take her into custody.

Malecki never told officers why she had called, the complaint states, but said she had been prescribed medication for depression and officers also found an empty schnapps bottle in the bathroom of the residence.

Malecki was freed from Waukesha County Jail Tuesday on a $2,500 signature bond.
