Elections Chief Wants More Time to Review Walker Recall Petitions

If the request is granted by a judge, a likely recall primary election would be held on May 15, with the general election on June 12.

 

The state's top election official plans to ask a judge for more time to review the Gov. Scott Walker recall petitions, which would push the date of a possible recall election back to May or June.

Government Accountability Board Director Kevin Kennedy on Friday recommended the GAB board request an push its deadline back from March 19 to April 6. Kennedy said his staff cannot complete its work on the recall petitions against Walker and Lt. Gov. Rebecca Kleefisch until at least March 30.

If the board moves forward with Kennedy's request at its meeting on Monday, the matter would go before Dane County Circuit Judge Richard Niess on Wednesday. If Niess grants the extension and the recall election was ordered on the newly proposed deadline, a recall election would be held on May 15. If a primary were required — which is likely in the governor's race — it would be held May 15 and the general election would be held June 12.

If a recall election was ordered on the original March 19 deadline, the recall primary would take place May 1, and the general election on May 29, the day after Memorial Day.

In a statement, former Dane County Executive Kathleen Falk, an announced Democratic candidate for governor, said she sees no reason why the election should be delayed because Walker has conceded there are enough signatures.

“This unprecedented delay will deny the will of the more than one million people who have followed the letter of the law to hold this election now," the Falk campaign said in a statement. "This move will disenfranchise them and it will disenfranchise thousands and thousands of university students across Wisconsin who will face obstacles for residency requirements never seen before in the history of Wisconsin thanks to the 28-day residency requirement in Gov. Walker’s voter suppression bill.

"We will pursue any and all means available to ensure Wisconsin’s university students are not disenfranchised by this unjustified and unnecessary delay.”

A May 15 primary election and a June 12 general election were the preferred dates expressed by county clerks. Kennedy said the proposed election schedule provides clerks with the most flexibility for addressing post spring election requirements without moving the election too close to Memorial Day. 

Kennedy and the GAB staff on Friday confirmed there are enough valid recall petition signatures to order a recall election against four state senators, but Kennedy said the board should advocate to have those elections on the same day as a gubernatorial recall election to save taxpayers money.

A preliminary survey by the GAB shows a single statewide recall event will cost counties and municipalities at least $9 million, a primary would cost another $9 million, and a separate senate recall election would cost an additional $1 million in each senate district.

Yes I know. One typo compared to......... I typically don't point out bloggers writing styles but I'm not the one who started throwing flames. I myself admit I got out of public school with very poor reading, writing and math skills. But over the years I have made an effort to correct that deficiency. Mau, the big difference is that this Pro-Walker rally is taking place at Brookfield Square, private property. We were prevented from gathering petition signatures there. So if this thing goes forward, look forward to us making a huge issue about this.

Somehow I think someone either with the organizers or with Brookfield Square made a mistake. Let's hope so for them, because this is going to be a huge PR snafu for the mall.

We did our rally on public property when we dropped off the petitions. Big difference.

“The proposed May 15th and June 12th Election Days are simply more unnecessary delay. GAB has already been given double the amount of time allotted under statute, the four Senate recalls have been certified, and there is no question enough valid signatures exist to recall Scott Walker and Rebecca Kleefisch. In fact, both have acknowledged as much publicly and failed to challenge a single signature.
“Reasons being offered for dates beyond a May 1st primary and May 29th general election simply do not justify delaying these elections. The statute does not provide that the date of the election be decided based on majority vote of the clerks regarding which date would be most convenient for them. Moreover, elections on the Tuesday following a federal holiday were just recently held on February 21st, and, by the accounts of GAB and county clerks, were very successful.

“Simply put, none of the stated reasons for delay justify denying the petition circulators and 1.9 million signers their constitutional right to an election in as timely a manner as possible. Enough is enough.”

Months back, someone fairly influential in the WI Democratic Party told me they wanted the recall election in November '12. I reminded that person that it wasn't up to them. And this wasn't a political game.

I was pleased when they finally stepped up because they have resources, but I'm disappointed but not at all surprised by this delay. I also wouldn't be surprised if the new timeline gets pushed back, too, to November.

This is one reason why I'm an independent.

I am aware of the idiot Schultz caving for PR. He is a limp noodle. I am not happy with him, but I am pleased to know there is only one idiot among the GOP.
What I can't understand is how the Demorats can look themself in the mirror after screwing over the Union workers. Milwaukee lost jobs due to this- mining equipment costs major bucks and is labor intensive to build, I spent 19 years affiliated with that.
The majority of Wisconsinites lack the critical thinking skills to undertand the depth of mining regulations. Give them a document explaining the rules and they will get glassy eyed. Imagine if they did understand though...then you can assume they must not care about jobs.
If you don't agree with that statement: then you don't understand mining.

This would probably be like the Keystone pipeline when it turned out the number of jobs created were way over inflated.

Look, ever business people like John Torinus felt that this was rushed, just like everything Walker is trying to do. with the pending possibility of the GOP loosing the state senate, it would not be too hard to imagine that the Three Stooges greased this baby up.

Not hard to imagine that there was a pot of campaign cash waiting for them at the end of the rainbow. And not hard to imagine that the Three Stooges would throw the environment would be thrown under the bus if it would satisfy their self serving aims.

We have a very precious water resource in this state, which Walker would sell out if it suits his purposes. Sorry for being so cynical about the Governor. But he has exhibited the character of a praying mantis.

Most of our taconite goes to China to keep up with their increasing demand. Your source is clueless to the real world of mining/manufacturing.

84 train jobs vs thousands of mining jobs, private vs borrowed federal money public vs private creation in general it isn't a comparison. A Spain built train is put on line in a few years, mine takes decades.

The article is pure speculation worded as fact. Mineral prices go up and down all the time and the mine wouldn't have produced a ton of taconite tomorrow if passed. There is no reason that Gtach would invest millions then not want dividends on that investment. Especially with Chinese demand so high for the ore. Possibly economic recovery here in America fueled by new resources that create jobs which creates demand which creates more need for resources.

But that was stopped, cold. Why not pull out if you go a few miles over to MI to open up shop. Innovation was hit hard this week.

The temporary jobs could likely be a combination of local jobs and out-of-state contractors.

Close examination of potential environmental damage needs to be done before embarking on large-scale projects. Mike Dee, driving a car or purchasing alcohol are not Constitutionally-protected rights. It's not fiscally conservative to spend $5-6 million on a Voter ID that is not justified. There is no evidence to suggest rampant fraud.

The Commonwealth of Virginia recently decided it couldn't afford their version of the Voter ID bill and voted it down.

@Mike Dee -- I'm currently driving on a license for which I haven't shown a birth certificate in over forty years. And there are places that will sell me alcohol without carding me, based on my obviously mature appearance.

Explain to me why I shouldn't simply be able to swap that driver's license (that started having my picture on it some years back) for a State ID card when I get to the age that my eyesight has gone?

@Bren --Or how about this -- spend that 5-6 million on issuing Photo ID voting cards to currently registered voters who qualified under the old rules? Or maybe just those few of them that didn't have other forms of Photo ID?

@Randy: That isn't a bad idea, except for a few people who have moved here under an assumed name (from another state). I saw on the news a story about a guy who went through the trouble to obtain his birth certificate from another state. He found out his real name was different than he was going by. It does make me wonder how many illegals and criminals are holding a valid DL issued in this state.
I would accept your proposal, as long as there was a way to weed out those who are wanted and in hiding. I personally would like to have fingerprints at the polls- no way to vote multiple times, and it would be an inexpensive and useful tool.
Of course that leads to debates on Big Brother with a fingerprint database..

Walker is now fighting to buy time before he is charged with criminal activity, and he is misleading the Wisconsin people along the way at he stares at the recall election.

Dan Bice gets a money quote from election law attorney extraordinaire, Michael Maistelman: "The only way you can set [a legal defense fund] up is if you are under investigation or being prosecuted. One can only draw the conclusion that either one of those two things is happening." Maistelman is widely regarded as the guy in Wisconsin you want if you need election law advice.

Go to the site where the GAB has photocopies of the petitions posted and do the legwork yourself. Why expect the taxpayers of Wisconsin to make it easier for you?
