GOP Files Suit to Force Election Officials to Strike Invalid, Duplicate Walker Recall Signatures

With election officials saying they wouldn't automatically toss out duplicate or fake names like Mickey Mouse or Adolf Hitler from petitions, GOP says the process of reviewing signatures is unconstitutional.

 

Gov. Scott Walker and the Friends of Scott Walker have filed suit against the state election board, arguing its process of reviewing petitions circulated in the recall effort against the governor is unconstitutional.

Filed in Waukesha County Circuit Court on Thursday, the suit asks the Government Accountability Board, the state agency that oversees elections, to vet and strike duplicate signatures and fake names from petitions submitted in the ongoing recall effort against Walker.

The lawsuit was filed after election officials said a few weeks ago, that there’s no prohibition on signing recall petitions more than once and the agency would not automatically strike names like Mickey Mouse and Adolf Hitler from the petitions — as long as those signatures were dated and had Wisconsin addresses.

One man told a Milwaukee television station that he put his signature on recall petitions more than 80 times.

The lawsuit argues allowing multiple signatures are a violation of the equal protection clauses of the state and U.S. constitutions and that those who sign several times end up trumping the voice of those who chose not to sign.

The GAB has said it's up to challengers to point out problems and the board would not automatically toss out the signatures for those reasons.

Democratic Party of Wisconsin Chairperson Mike Tate said at a press conference Thursday, volunteers have a comprehensive process of vetting signatures, and they have stricken duplicate or invalid signatures from petitions.

"We have a very extensive signature verification process that goes through and makes sure that petitions we hand in are valid," Tate said.

"There will be some errors on them; there are obviously some people that will sign Mickey Mouse to try to mess with the process and give the Republicans a few good talking points," he added, "but I am extremely convinced that not only are we are doing our due diligence, but that there is … hundreds of thousands of residents that have accurately signed these petitions that want to recall Scott Walker.”

Typical liberal cheaters. If their cause is so just, then they shouldn't have to cheat. Yet they continue to cheat election after election. You can easily subtract 10% from the democrat side and add 10% to the Republican side in every single election to offset the liberal cheaters.They may get their signatures, but Walker will win this recall by a landslide. My side side is ready to fight and we are sick of all this recall crap.

What makes you think we'd want to cheat? It's hardly in the interest of recall supporters to present duplicate signatures that can be struck on challenge.

It all depends on the chances of those duplicate signatures actually being challenged and struck from the count. I would imagine that lots of people think that duplicate signatures would be hard to detect and challenge when there are 700,000+ signatures to pore through...

I am definitely for Walker's recall and would like to see it happen following strict adherence to the law/constitution. I have witnessed that strict adherence after the petition reviewers asked me to bring my petition back to the signer that dated it incorrectly. I think it should be the GAB's responsibility to do the final count, but the responsibility of the challengers and the challenged party to carefully review the signatures.

You are kidding yourself if you think the Republicans wouldn't be checking each signature even if it was the responsibility of the GAB. The GAB never said it WILL NOT toss-out extra signatures. They stated they won't automatically do it meaning if the Republicans find errors, they can submit them to the GAB and the GAB will review them and most likely toss them at that point. But again, the responsibility falls on the challenged party.

And lets not forget the reason for this lawsuit. Just like entering false candidates, it is a well-conceived ploy by the Republicans to delay the recall election to time it better with the presidential election. That is why it was done in Waukesha county. They know they'll win there and they are hoping it will go all the way to the Supreme Court (i.e.: causing more of a delay). Justice all too often peeks out from behind that blindfold.

False candidates? A strategy pulled directly from the democrats playbook (see Manitowoc). Funny how you are against that now that Republicans try it. And don't give me that they took it to Waukesha so they could win crap, democrats take their goofy suits to Dane county for the same reason.
This whole "recall" is a colossal waste of time and money and sets a very dangerous precedent. Every time someone doesn't like a vote or a position of an elected official we are going to go into recall mode? Immature and sophomoric.

Obama ran saying "he's not Bush", no solutions were ever part of his campaign. He promised to make things "better", "more jobs" etc. But could never present any details.He is a total flop.
Flash forward to Wisconsin. The recallers present no solutions, they are angry, they just don't like Walker. Well "don't like" someone all you want, but until you can put-up some ideas, SHUT-UP.
The state is on it's way towards recovery, Walkers system is working. If you have better ideas, let's hear them...Waiting...Waiting...Waiting, That's what I thought.

Wow, I know conservatives like to rewrite history, but seriously? Obama had no solutions in his campaign? I guess Fox didn't bother to send it's mindless minions much information on that, but there were quite a lot of concrete solutions. Check out PolitiFact for a long list of campaign promises, some kept some not. However, certainly the 3M jobs created or saved by the recovery act, the fact that we still have an auto industry, and that the economy has been growing for three straight quarters probably doesn't get mentioned on fact free Fox, either.

Governor Walker is not against higher education. He does however see that the costs have skyrocketed unreasonably high. We need to be smarter in the manner we spend money, and not on stupid or overpriced things.

There are few things on this earth more hypocritical than Walker and his cronies whining about unfairness and unethical behavior. They pretty much wrote the book on that stuff. GAB used Hitler and Mickey Mouse as examples....not actual signatures. Being able to read would have told you that.

Additionally, with the millions of dollars Walker has raised, largely from out-of-state corporate interests, surely he can afford to hire some help to go through signatures. That opportunity is part of the system This suit is both a delay tactic and an attempt to divert attention to a scapegoat, in this case, the GAB. In a way, I like the fact that Walker and his cronies continue to insist that it's factions from outside of Wisconsin that are pushing for his recall. By remaining so oblivious, it will be even more surprising when they do get around to checking out thousands upon thousands of legitimate signatures form every day, ordinary Wisconsin citizens.

Tom Duffes: The GAB should verify every signature- not Walker! Not the taxpayor!
IF there is no voter ID verification process then it is likely impossible to catch fraud.
To give Walker the burden of verification is a joke. Based on that premise- if even one fraudeulant signature is found- the whole petition should be found to be fraudeulant.
I guess you are in favor of the lawsuit filed by NAACP regarding voter ID. What part of a free ID is too expensive? How does this disenfrenchfry the poe people?

Fake signatures are signed by the supporters of the candidate being recalled in an attempt sabotage the recall efforts. It is similar to Sen. Scott Fitzgerald's running fake Democrats in last summer's senate recall elections.

There is a HUUUUGE difference between the Tom Amendt recall and this one. Milwaukee still calls it "The Milwaukee County Pension Scandal". That was a case where the politicians paid themselves and their cronies millions of dollars in pension benefits at the expense of the taxpayers.

This recall is all about Governor Walker taking away the power from union bosses that they have abuse for so long. Our schools no longer have to pay for overpriced health insurance. We can actually get rid of bad employees. We can actually get an honest days work out of them as well.

And, let's not forget that the Milwaukee Pension Scandal recalls were driven by Citizen's for Responsible Government, not the Democratic party.

Im sorry your such an idiot that you can't stay on the topic of the signatures and move to the motive behind the recall and tell me that I am the one comparing two different items. I am talking about recall protocol, and it was and is the same since the 1980's. Unless you are trying to say the reason that he is suing is not because of the signatures but the reasoning behind them. If that is the case, then we seriously have some issues.

Who the hell cares if the GAB is required to count every signature. Hiring extra help to count will create some jobs. This will keep the process honest and give the Goppers something new to bitch about after the nearly 3/4 million are counted and certified. Furthermore, it will delay the process until after the April Presidential primary.

At least we still may say that we have firmly the laughter on our side. As reported by WisPolitics, the Governor’s lawyers produced as evidence of fraud a recall petition with a signature from “Bugs Bunny”– but the petition was actually from the GOP-led recall effort last year against Democratic State Senator Jim Holperin.
