Man Caught in Waukesha With Marijuana

Drug charges come after police respond to call of men with baseball bats ready to fight

 

A 19-year-old Racine County man is facing charges after he was found in Waukesha carrying marijuana and a pipe in his pocket.

Donald A. Smith of Caledonia was charged in Waukesha County Circuit Court Wednesday with one count of possession of THC, the active ingredient in marijuana, and one count of possession of drug paraphernalia. If convicted, he faces up to seven months in prison and $1,500 in fines.

According to the criminal complaint:

On April 13, Waukesha police officers were called to Aurora Street and Beechwood Avenue after someone reported there was a group of people with a baseball bat trying to entice others to fight them. When officers arrived, they found Smith and four other men standing outside of a car.

Officers checked the men and discovered Smith had three active arrest warrants issued by the Oak Creek Police Department. He was searched and officers found the marijuana and pipe in his pocket.

Smith will make his initial appearance in court Aug. 13.

first of all we werent on aurora and beechwood, they totally had the wrong house and the wrong people but they wanted to bother us instead. there was a party going on down the road and i heard them out there fighting about 20 min before the police arrived when the police were arriving we were leaving we were a block away from the fight and they still wanted to harass us smh waukesha pd

Your kidding me... The police arrested the wrong criminals? Maybe if you explain that to them they'll give you your weed and bong back and send the other guy back out on the lam.

@ Nic - The Waukesha Police did not arrest him for fighting. He was congregating in an area where a fight had been reported. He had outstanding warrants along with a bag of weed and a pipe. Let me guess: he didn't know about the warrants and the weed was prescribed for his grandmas glaucoma.

i am the one that was arrested i was not congregating at all we simply were walking out of nic's hosue and getting into the car to leave to our friends house the incident that was going on was 4 houses down they had no reason to talk to us or bother us with anything. they didn't arrest anyone but me and didn;t even give a shit about the fight that was going on down the street or had went on either/or it doesn't matter. it's ridiculous that i walk out a door and 20 seconds later am being questioned by the cops about a fight and stuff that i had no part or even knew about at all in any way they arrested me on warrants for tickets yes but i had nothing to do with any of the problems going on they completely portrayed this completely wrong. they should have said 19 year old man aressted walking out of friends house and illegal search and siezure gets him two misdemeanor charges and then was ran for warrants and arrested on them also. either way thats the world for you now a days get the kid who has weed and the people chasing a truck down with a bat gets to run free great "protecting and serving" in my opinion ......not.

You admit you were breaking the law, but you think you should get off on a technicality that doesn't exist. The "ticket" you had a warrant for wasn't exactly a speeding ticket. You have burglary charges pending against you. Stop worrying about the "guy who got away" because the judge isn't going to care.

b) having warrants and walking around with weed,
