Fox Run Lanes Gets Approvals for Smoking Room

Uncertain if the plans would meet state smoking ban requirements, Waukesha Plan Commission tells owner it's owner's responsibility to ensure addition meets state law.

A designated smoking area at won Plan Commission approval Wednesday despite concerns over whether the area fell under the state's smoking ban. 

Plan Commission member Rick Congdon, also an attorney and former Waukesha County judge, made it clear the responsibility of following the state’s smoking ban was up to the owners. While the commission approved the addition, the use of the addition is up to the owner.

“The applicant is at his or her risk,” said Congdon about whether the plans will meet the state requirements for the smoking ban. Several other commissioners agreed.

The 192-square-foot addition will be placed on the west side of the building at 2440 W. Sunset Drive.

Wisconsin’s smoking ban was enacted in July 2010 and some area bars have created designated smoking areas or smoking shelters for their patrons to accommodate smoking patrons.
