Complaint: Man Points Gun on Freeway Driver During Texting Dispute

A Dousman man tells a Waukesha County deputy he was moving his gun from his hip holster to the passenger seat after telling the other driver to not text and drive, according to the criminal complaint.

 

A 40-year-old Dousman man is accused of pulling a gun and pointing it at a driver on Interstate-94  after he got upset with the other person’s driving.

Tan A. Tran was charged in Waukesha County Circuit Court on Wednesday with one count of pointing a firearm at another person, one count of carrying a concealed weapon and one count of disorderly conduct with use of a dangerous weapon. If convicted, he faces up to 21 months in prison and $21,000 in fines.

According to the criminal complaint:

At 8:30 a.m. Sept. 12, a man was driving eastbound on I-94 near Highway C in Delafield when Tran came up behind him and was flashing his lights and honking his horn. After about a minute, Tran got into the right lane next to the vehicle, flipped the driver off, then pulled a handgun and pointed at the vehicle.

The man called the Waukesha County Sheriff’s Department and Tran was pulled over and arrested on Jill Drive near South Mary Ann Drive. Officers found a gun on the passenger seat with seven rounds in a magazine and the safety off.

Tran told officers he didn’t point a gun at the other driver, but noticed the person was texting and driving, so he pulled next to him and said “stop texting, it is illegal to text and drive.” Tran said he had a gun in a hip holster, which he pulled out and put on the seat because his hip hurt from an August motorcycle accident.

Tran said he was on his way to Fletcher Arms in Waukesha at the time of the incident, but was unable to give adequate directions to the store. He was asked again about pulling the gun and Tran said when he pulled the gun out, he had to hold it high because his car is a stick shift.

Tran will make his initial appearance in court Dec. 10.

Take note, he does not have his permit to Carry Concealed, so none of you anti-gun whiners bring that up.

I have so wanted to do that to annoying drivers who are texting/talking and not paying attention. fortunately, I don't carry a gun.

Jason - no need to have a license (it's not a permit in WI). Open carry in a car is legal with no license. Some people haven't been charged (because the cops & DA knew the law), some have won court cases (because the defendent & jury knew the law better than the cops & DA).

With all the traffic-cams out there, I'd expect to see some footage of this supposed road rage incident. It would at least show if he was tailgateing & flashing his lights, as the texter claims.

I am curious how he expected to be able to talk to the texter while driving on the freeway.

And I'm a bit skeptical of the claims about why he put it on his seat, and why he had to bring it into sight. My car is a stick shift, & I bet I could do that w/o a driver next to me noticing.

And BTW, why is there no mention of the texter being ticketed??
