A 40-year-old Dousman man is accused of pulling a gun and pointing it at a driver on Interstate-94  after he got upset with the other person’s driving.

Tan A. Tran was charged in Waukesha County Circuit Court on Wednesday with one count of pointing a firearm at another person, one count of carrying a concealed weapon and one count of disorderly conduct with use of a dangerous weapon. If convicted, he faces up to 21 months in prison and $21,000 in fines.

According to the criminal complaint:

At 8:30 a.m. Sept. 12, a man was driving eastbound on I-94 near Highway C in Delafield when Tran came up behind him and was flashing his lights and honking his horn. After about a minute, Tran got into the right lane next to the vehicle, flipped the driver off, then pulled a handgun and pointed at the vehicle.

The man called the Waukesha County Sheriff’s Department and Tran was pulled over and arrested on Jill Drive near South Mary Ann Drive. Officers found a gun on the passenger seat with seven rounds in a magazine and the safety off.

Tran told officers he didn’t point a gun at the other driver, but noticed the person was texting and driving, so he pulled next to him and said “stop texting, it is illegal to text and drive.” Tran said he had a gun in a hip holster, which he pulled out and put on the seat because his hip hurt from an August motorcycle accident.

Tran said he was on his way to Fletcher Arms in Waukesha at the time of the incident, but was unable to give adequate directions to the store. He was asked again about pulling the gun and Tran said when he pulled the gun out, he had to hold it high because his car is a stick shift.

Tran will make his initial appearance in court Dec. 10.
