Collective Bargaining Law Upheld by Federal Appeals Court
Act 10, which essentially stripped public unions of their ability to bargain, was ruled constitutional on Friday in a federal appeals court.
The controversial state law that curtails collective bargaining for most public employees was upheld by a federal appeals court Friday.
In ruling that Act 10 is constitutional, the 7th Circuit Court of Appeals said the state had a rational reason for rolling back collective bargaining rights, and rejected arguments from public employees unions that they violated First Amendment rights, WisPolitics.com reported.
The court overturned a decision by a federal judge last year that struck down parts of the law dealing with prohibitions on government employers withholding union dues from workers' payrolls and a section requiring labor unions to vote to re-certify yearly, the Journal Sentinel reported.
A separate case challenging the law remains ongoing at the state level.
Friday's decision was praised by Gov. Scott Walker, who introduced the legislation as part of his budget repair bill in 2011.
As we've said all along, Act 10 is constitutional.
Today’s court ruling is a victory for Wisconsin taxpayers. The provisions contained in Act 10, which have been upheld in federal court, were vital in balancing Wisconsin’s $3.6 billion budget deficit without increasing taxes, without massive public employee layoffs, and without cuts to programs like Medicaid. With this ruling behind us, we can now focus on the next state budget, which will invest in priorities to move our state forward.
State Attorney General J.B. Van Hollen also applauded the ruling:
For nearly two years, those opposing Act 10 have tried every angle to have it struck down and invalidated. Today’s decision by the Seventh Circuit confirms what I have stated from the beginning. Act 10 is constitutional. While there are no guarantees, it is my hope that this decision will pave the way for resolving any remaining challenges in a manner that supports the legislative decisions made by our elected officials.
Mike Tate, chair of the Wisconsin Democratic Party, said:
We continue to believe that Scott Walker’s Act 10 is divisive, harmful and polarizing policy that sought to reward Walker’s political allies at the expense of working Wisconsin families.
Even the federal appeals court that today upheld Act 10 on narrow legal grounds noted that the principal provisions of Act 10 fit the description of legislation that 'rewards friends and punishes opponents.'

No big surprise with the ruling since public employee unions were statutory and not found in the state constitution. Nothing here to celebrate or mourn, what's done is done. I suspect voter ID will be a much different story.

Yes, rather than do an exhaustive search and find out how many people pay income taxes, how many people pay sales taxes, and how many people pay property taxes, then cross-reference them to eliminate duplicates (like myself) across those lists, I reasoned that we are ALL taxpayers.
Even my children since the money I pay to taxes doesn't go into their college accounts.
Even my retired mother since property taxes factor into the amount of rent she pays.
Even those that live in their parent's basement (thanks to the Obamaconomy) that drive and pay 51.3¢ per gallon for fuel.
About the only ones that don't pay any sort of taxes are those, like yourself, that live completely off government assistance!
But let's play your game. What percentage people pay just property taxes in Wisconsin. let's not even count those that indirectly pay through rent. 1/2? 1/4? Lets take 1/4. That still means the ratio is

It also clearly demonstrates the impossibility of Walker creating 10,000 new businesses by Jan. 1, 2015.
Jobs gained or lost by previous WI governors is decidedly NOT the issue(s) here… deflect though you might. The only two issues here are Walker creating 250,000 jobs and 10,000 new businesses in WI before Jan. 1, 2015, as he promised…

Well, we still have no answer if the budget "surplus" is what was achieved after the $500 million Walker borrowed to "balance the budget" in time for the recall election has been paid back, or if borrowed money has been placed in the cash register and we're calling it a surplus. If the latter is the case, he should pay as much of the $500 million down as possible with the so-called surplus to avoid some of the $150 million in interest charges coming our way over the next 20 years.
Furloughed employees, borrowing money, instead of calling him Gov. Scott Walker it's beginning to look more like Doyle II. Except Doyle knew how to negotiate with public employees.
That campaign promise, recently doubled-down upon, was 250,000 new jobs by the end of his first term, no, wait, by the end of 2015. We are nowhere near that and the probability of it being achieved is near "0." So why promise it.

I seem to recall that Doyle ripped off the Patient Compensation Fund, to the tune of $250 million, and Doyle also forgot to pay Minnesota tuition of around $59 million. Those two line items alone appear to cover about 60% of the total that you speak to.

@Bren... I think the focus of the discussion is the State and its financial condition;not the County.
The monies received in the mortgage settlement were allocated/spent within the confines of the legal agreement. Direct foreclosure relief to homeowners accounts for 82% of the total funds. No court order to return monies from the mortgage settlement exists and I am not aware that a legal challenge is contemplated..
There is/was a Court Order for the State to return the funds+interest, to the Patient Compensation Fund, because the State(Doyle) mis-allocated the funds.
The refinancing(Walker) saved the State $78 million over the first two years, due to a significantly lower interest rate.
So, its 78(Lower Interest)+250(repay Patient Compensation Fund+59(MN Tuition)= 387 or about 77% of the total that you speak to.

You are correct; the same methodology that applies to the national unemployment numbers also clearly apply to each state.
Both - the federal and the states - attempt to play games with the numbers and percentages by not counting people not currently collecting unemployment benefits, those who have given up looking for work through state agencies and contract employment agencies, those who are in some government or school training program and those who are working 2-3 minimum wage jobs and would thus not be eligible for benefits.
Some employers will not even look at you unless you are currently employed.
I know of several employers who have their sons and daughters working for them full-time, and they are collecting full-unemployment benefits from the state at the same time. I have reported them to the Dept. of Workforce Development.
Sadly, there are many good employment opportunities to be had in the labor market today. On the other hand, there are too many people without the skill sets to fill them. You need degrees, CNC Programming skills, computer skills, robotic skills, a good stable work record, no drug or criminal record.
What I refer to as the “brawn class” is going to grow beyond all comprehension, as there is increasingly no need for a strong back type of worker. Additionally, employers do not want to be stuck with older workers – at around 50-55 you are an insurance and productivity liability – but they will not tell you that.

The cost of an education is too much to bear - student loans allow the cost to be pushed forward - and college budgets are bloated and teachers overpaid.

This was a sound ruling. Hopefully the Public Sector Unions will learn that their days of sucking the taxpayers dry are over.
And anyone who says that those without college degrees are less worthy - you are showing your elitist attitude and disregard for a basic tenant of humanity: all men are created equal. No one is less worthy of respect because of their education level. (Although some of these so called "educated liberals" show that they are less worthy of respect by thinking they're better than others).

@Marty.....My point is that whether someone has a college degree or not is immaterial. In regards to our governor, although he didn't complete his degree, Professor Mordecai Lee has made repeated statements that Scott Walker is the most gifted and natural politician he has ever met. However, those with a real advanced education tend to have a better grasp on more complex issues and not all college degrees are created equal. The truly educated have been taught to think and write critically as well as possessing the ability to clearly communicate. People holding degrees in what I term occupational degrees; such as business degrees, nursing, teaching, social work, etc; are more occupational training programs than true collegial programs. Also, where one does their post secondary work is important as well. Those educated in liberal arts institutions come closer to being members of the educated elite. I've known many with college degrees that didn't know much of anything and couldn't begin to discuss art, literature, philosophy, politics, religion, etc. You could probably label me an elitist, but I don't see that as a negative.

@Lyle - and my point was that a college degree doesn't make someone any more valuable a human being than someone who doesn't.
If being an elitist means you think you are better than someone who doesn't have a degree, than I say that makes you simply a jerk (not saying YOU are, but someone who thinks that is clearly)

@Marty....Yes, all are created equal and should be afforded the up most respect until such time as they act in such a manner as to lose the respect of others. There are a number of individuals who post comments or blog who are beyond being civil and appear to be barely civilized. They are either incapable or unwilling to discuss controversial issues in a manner deserving of respect or serious consideration.
There is clear and unquestioning bias against those who are better educated and it is expressed as disdain towards anyone who is an open intellectual or pursues intellectual pursuits.

Lyle, apparently, the degree didn't help you. And the educated elite are legends in their own minds. I proud that I have been able to accomplish much in life without a degree. And I harbor no ll feelings towards those that have degrees. But it doesn't make one smarter than the other. But for elitist like you, it only serves as toilet paper for everyone else.
